1. Scope

These Terms & Conditions govern the use of the website operated by Alpen-Care GmbH (hereinafter "Alpen-Care") and any services offered therein, including but not limited to contact forms, partner portals, and candidate submission platforms.

2. Service Description

Alpen-Care is a state-certified healthcare staffing agency (§ 4 AVG & AÜG) specialising in the placement of qualified nursing and medical professionals into permanent employment with Austrian healthcare institutions. Alpen-Care does not provide temporary agency leasing (Arbeitskräfteüberlassung).

3. Contractual Relationship

A binding contractual relationship between Alpen-Care and a client (employer or partner agency) is established only upon execution of a separate written placement agreement. Use of this website or submission of an enquiry does not constitute a binding contract.

4. Obligations of the Client

Clients agree to:

Provide accurate and complete information about their staffing needs
Comply with all applicable Austrian labour and employment law
Offer employment conditions consistent with the applicable collective agreement (Kollektivvertrag)
Not contact or hire Alpen-Care candidates outside the agreed placement process

5. Placement Fee

Placement fees are defined in individual agreements between Alpen-Care and the client. Fees become due upon successful commencement of employment by the placed candidate. Specific terms are set out in the respective placement contract.

6. Candidate & Partner Agency Obligations

Candidates and partner agencies submitting profiles agree to:

Provide truthful and verifiable information regarding qualifications, work experience, and language skills
Inform Alpen-Care promptly of any changes to their availability or documentation
Not enter into direct employment arrangements with Alpen-Care clients outside the placement process

7. Intellectual Property

All content on this website — including text, images, logos, and design — is the intellectual property of Alpen-Care GmbH or its licensors and is protected by copyright. Reproduction, distribution, or modification without prior written consent is prohibited.

8. Limitation of Liability

Alpen-Care takes reasonable care to ensure the accuracy of information on this website. However, we accept no liability for:

Errors, omissions, or outdated content
Damages arising from the use of this website
The conduct or performance of placed candidates after commencement of employment
Decisions taken by Austrian authorities regarding visa, work permit, or qualification recognition

9. Governing Law & Jurisdiction

These Terms & Conditions are governed by Austrian law. The exclusive place of jurisdiction for any disputes is Graz, Austria.

10. Severability

If any provision of these Terms & Conditions is found to be invalid, the remaining provisions shall remain in full force and effect.

11. Changes

Alpen-Care reserves the right to amend these Terms & Conditions at any time. The current version is always available on this page.
